This Privacy Notice is intended to inform you which personal data we collect, what it is used for and how we protect it, always respecting and complying with the Mexican legislation applicable to the protection of personal data.

Personal data subject to processing

Energon will only process the personal data that is necessary for the purposes informed in this Privacy Notice and may process the following categories of personal data:

Identification Full name, signature, photograph, CURP, RFC, Social Security Number, official identification, passport, nationality, telephone number and email address.

Dates and times of entry and exit, reason for the visit or entry, authorized areas, person visited, access records, credentials, authorizations, restrictions and incidents.

Driver or operator data, driver's license, license plates, vehicle characteristics, insurance policies and entry and exit records.

Induction and training records, work permits, risk analyses, authorizations for specific activities, non-compliances, accidents, incidents and documentation related to their investigation and follow-up.

Documentation required to verify affiliation and status with the IMSS (Mexican Social Security Institute), as well as compliance with the legal requirements applicable to suppliers and contractors established by contract.

Information required to handle maintenance, after-sales, warranty, technical support and training requests.

Transfer of personal data

Energon may carry out the following national or international transfers of personal data without requiring the Data Subject's consent, only when such transfers are legally permitted and necessary for the purposes indicated below:

To the owners, administrators or operators of the industrial parks or properties in which Energon has facilities or dealerships, exclusively when the transfer is necessary to manage and control access to such facilities, implement security measures, respond to emergencies or comply with the legal, regulatory or operational requirements applicable to the property, provided that there is a legal relationship that justifies the transfer and it is legally appropriate.

Protection and retention of personal data

Energon has implemented and maintains reasonable and appropriate administrative, technical and physical security measures to protect personal data against damage, loss, alteration, destruction, unauthorized use, access or processing, as well as against improper disclosure.

Personal data will be retained for the time necessary to fulfill the purposes for which it was collected, as well as to address the applicable legal, contractual and commercial obligations.

Once the personal data is no longer necessary to fulfill those purposes and the corresponding obligations, it will be deleted or blocked prior to its elimination, in accordance with the terms, procedures and other provisions established in the applicable legislation.

Exercising ARCO rights

The Data Subject, or their duly accredited legal representative, may exercise the rights of Access, Rectification, Cancellation and Objection (hereinafter, the “ARCO Rights”) with respect to their personal data, in accordance with the requirements and procedures provided in the applicable legislation.

Energon will receive and process the requests, verify compliance with the applicable requirements and communicate the corresponding determination to the Data Subject within the periods established in current legislation, when the request is appropriate.

If the request does not contain the information or documentation necessary for its attention, or if it is insufficient or inaccurate, Energon may require the Data Subject to provide the additional elements that allow the request to be processed, in the terms and within the periods provided by the applicable legislation.

Revocation of consent and limitation of use
